Man's Alcohol Level 0.46, 0.40 is Lethal

Man's Reason For Missing Jail Date: Detox

(AP) Houston, Minn. A 47-year-old man who violated probation didn't show up to serve his time at the Winona County Jail because he was in a hospital for detoxification with a dangerous amount of alcohol in his system.

James Edmund Erickson II, of Houston, Minn. had a blood-alcohol level of 0.46 percent -- exceeding the potentially lethal mark of 0.40 percent -- when Houston police found him unconscious on a city sidewalk, according to a police report.

Last week, Judge Mary Leahy in Winona County District Court allowed Erickson the weekend to handle any business before having to report Monday for a 90-day sentence for violating probation on a 2005 conviction for drunken driving and criminal vehicular injury.

After Winona County put out a warrant Wednesday, Houston County authorities alerted them to Erickson's whereabouts.

On Thursday, Erickson appeared in court again on the arrest warrant, and Leahy reprimanded him.

"Do you realize how close you were to dying? You're like, beyond the 'I-have-a-drinking-problem' stage," Leahy told Erickson, before sending him to jail.
